NhaCuaCali Terms of Use

By accessing or using NhaCuaCali, you agree to these Terms of Use. Where affirmative acceptance is required for account creation or specific functionality, an appropriate unchecked acceptance checkbox is provided.

NhaCuaCali provides technology and resources intended to help consumers navigate portions of the home-buying process. Current functionality may include:

• Buying Power tools to estimate affordability
• Pre-Approval connections and workflows
• Property exploration and saved homes
• Showing requests
• Offer preparation and planning workflows
• Post-offer and Buy guidance
• Professional connections
• Communication and messaging
• Open House registration
• Get Help requests

Calculators, estimates, educational information, AI-assisted information, general explanations, and similar platform content are provided for informational purposes unless explicitly stated otherwise. They are not substitutes for individualized:

• Legal advice
• Tax advice
• Financial advice
• Licensed real-estate advice
• Mortgage underwriting or approval
• Insurance advice

from the appropriate qualified professional.

Buying Power outputs are estimates and are not loan approvals, loan commitments, guarantees of financing, or guarantees of purchasing ability. Actual qualification depends on lender and program requirements, credit review, income and asset verification, and underwriting.

Mortgage origination, pre-approval, underwriting, rate and term determinations, and lending activities are performed by the applicable licensed mortgage or lending entity or professional — not merely by the NhaCuaCali technology platform. NhaCuaCali helps connect consumers with mortgage professionals but does not make mortgage credit decisions.

Licensed real-estate activities are performed by appropriately licensed real-estate professionals and their applicable brokerage. Use of NhaCuaCali alone does not create an agency relationship. Any agency relationship should arise through appropriate agreements and applicable law.

NhaCuaCali may facilitate connections between consumers and Professionals. NhaCuaCali does not guarantee:

• Professional availability
• Professional performance
• Transaction outcome
• Financing
• Property availability
• Offer acceptance
• Closing

Users should disclose existing professional relationships where relevant. Nothing in NhaCuaCali should be interpreted as intentionally inducing a consumer to violate an existing representation agreement.

Users are responsible for:

• Providing accurate information
• Maintaining account security
• Protecting credentials
• Activity conducted through their account

Users must notify NhaCuaCali of suspected unauthorized account use.

Users grant NhaCuaCali a reasonable license to host, process, store, reproduce, transmit, display internally, and otherwise use information and content they voluntarily submit as reasonably necessary to:

• Provide requested services
• Operate the platform
• Communicate with users
• Connect authorized Professionals
• Maintain records
• Improve and secure the service
• Satisfy legal obligations

NhaCuaCali does not claim ownership of the user's underlying personal information or documents.

NhaCuaCali retains rights, as applicable, in its:

• Brand, trademarks, and logos
• Original software and interface
• Workflows and databases/database structure
• Graphics, educational content, and original text
• Analytics and proprietary platform materials

Except where permitted, users may not copy, reproduce, scrape, republish, reverse engineer, distribute, or commercially exploit protected NhaCuaCali materials.

Prohibited conduct includes:

• Unauthorized access
• Impersonation
• Fraud
• Malicious code
• Security circumvention
• Scraping or harvesting
• Unauthorized collection of customer information
• Interference with platform operation
• Unauthorized commercial use
• Misuse of Professional or customer information

NhaCuaCali may send service-related communications. Marketing consent is kept separate where required. Acceptance of these Terms alone is not treated as automatic SMS marketing consent.

Submitting information through Open House check-in, Get Help, Agent Help Request, Showing Request, or similar forms permits NhaCuaCali to process the information to respond to that request according to the Privacy Policy and the user's communication choices. Submission does not automatically establish an agency relationship.

NhaCuaCali may link to or use third-party services. NhaCuaCali is not responsible for third-party content, availability, or practices beyond applicable legal obligations.

NhaCuaCali does not guarantee:

• Finding a property
• Obtaining financing
• Interest rates
• Appraisal outcome
• Inspection outcome
• Property condition
• Offer acceptance
• Escrow performance
• Closing date
• Completed transaction

NhaCuaCali may modify, suspend, or discontinue platform functionality where appropriate. The service may occasionally be unavailable.

NhaCuaCali may restrict or terminate access for violation of Terms, security risk, fraud, abuse, unlawful activity, or misuse of platform or customer information, subject to applicable law.

NhaCuaCali is provided on an "as is" and "as available" basis. To the extent permitted by applicable law, NhaCuaCali disclaims warranties not expressly stated in these Terms. NhaCuaCali does not warrant that the platform will be error-free, uninterrupted, or free of harmful components. This disclaimer does not attempt to disclaim responsibilities that cannot legally be disclaimed.

To the extent permitted by applicable law, NhaCuaCali's liability for claims arising out of or related to the platform is subject to reasonable limitations. This provision does not impose an arbitrary aggressive damages cap and is subject to attorney review and applicable law. Nothing in this section limits liability that cannot be limited under applicable law.

To the extent permitted by applicable law, users agree to indemnify and hold NhaCuaCali harmless from claims arising out of unlawful misuse or material violation of these Terms by the user. This provision is subject to attorney review and applicable law.

These Terms are governed by applicable law. A California governing-law provision is contemplated, subject to attorney review.

Note: Attorney review is required before adding mandatory arbitration, venue selection, class-action waiver, or other dispute-resolution restrictions.

NhaCuaCali may update these Terms. Material changes may require renewed acceptance where appropriate.

These Terms of Use are the first production version. English is the authoritative version. A Vietnamese translation may be provided for convenience but does not override the English version.
